1. What Pendar Is
Pendar is a communication assistance tool designed for mortgage loan officers. It generates emails, text messages, call scripts, and video scripts based on scenarios you select and borrower information you provide.
Pendar is not a legal, financial, compliance, or regulatory advisory service. Nothing generated by Pendar constitutes legal advice, financial advice, or compliance guidance of any kind.
2. User Responsibility
You are solely responsible for all communications you send to clients, borrowers, colleagues, or any other party. This includes:
- Reviewing all content generated by Pendar before sending
- Ensuring all communications comply with applicable laws, regulations, and your employer's policies
- Verifying that generated content is accurate, appropriate, and suitable for the intended recipient
- Obtaining any required approvals from your employer, branch, or compliance team before use
Pendar does not review, approve, or monitor the communications you send. You use generated content at your own discretion and risk.
3. No Guarantee of Outcomes
Pendar makes no representations or warranties regarding the effectiveness of any communication generated by the service. Generating a communication does not guarantee any business outcome, including but not limited to loan closings, borrower responses, referral conversions, or realtor relationships.
4. Subscription and Billing
Pendar is offered on a monthly subscription basis. By subscribing, you authorize Pendar to charge your payment method on a recurring monthly basis until you cancel.
- Current subscription price: $29.00 per month
- Subscriptions renew automatically unless cancelled
- You may cancel at any time through your account settings
- Cancellation takes effect at the end of the current billing period
- Pendar reserves the right to change pricing with reasonable notice to subscribers
Pendar does not currently offer refunds for partial billing periods. If you believe you have been charged in error, contact support@pendar.pro.
5. Acceptable Use
You agree not to use Pendar to:
- Send spam, unsolicited commercial messages, or bulk communications
- Harass, threaten, or mislead any person
- Misrepresent your identity, credentials, or the terms of any loan product
- Violate any applicable law, regulation, or professional licensing requirement
- Attempt to reverse engineer, copy, or reproduce the Pendar platform or its underlying systems
Pendar reserves the right to suspend or terminate accounts that violate these terms.
6. Intellectual Property
The Pendar platform, including its scenario taxonomy, prompt architecture, and user interface, is the proprietary property of Pendar and its owner. All rights are reserved.
Content generated by Pendar on your behalf is yours. You own full rights to any email, text message, call script, or video script generated through your use of the service. Pendar claims no ownership over your generated output.
7. Privacy and Data
Pendar collects only the information necessary to generate your communications. This includes your name, company name, and the borrower first name and scenario details you provide for each generation.
Pendar does not collect, store, or process borrower Social Security numbers, loan application data, financial records, or any non-public personal information (NPI) as defined under applicable privacy regulations.
Your use of Pendar is subject to our Privacy Policy.
Pendar uses the Anthropic API to generate content. By using Pendar, you acknowledge that communication inputs are processed through Anthropic's systems in accordance with Anthropic's Business API usage policies.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Pendar and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to:
- Errors or inaccuracies in generated content
- Compliance violations resulting from use of generated communications
- Loss of business, clients, or revenue
- Any action taken by your employer, licensing authority, or regulator based on communications you sent
In no event shall Pendar's total liability to you exceed the amount you paid for the service in the three months preceding the claim.
9. Disclaimer of Warranties
Pendar is provided "as is" and "as available" without warranties of any kind, express or implied. Pendar does not warrant that the service will be uninterrupted, error-free, or that generated content will meet your specific requirements or comply with any applicable regulation.
10. Changes to These Terms
Pendar reserves the right to update these Terms of Service at any time. Material changes will be communicated to subscribers via email. Continued use of the service after notice of changes constitutes acceptance of the updated terms.
11. Governing Law
These Terms of Service are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Ontario County, New York.
